We found out our car was previously crashed!

We bought the car in dublin 12 and turns out that car was on 2 accidents and it was rolled off the road. We didnt have that info at the day of purchase. Dealer said that he will check this and will give us a refund but I am not sure if he will do. Other people had similar problems with them. So how is that safe purchase? What can we do now?

Our answer:

Hi Monika,

Right, get yourself a good solicitor. If you were sold a car that was previously written off and were not informed of it at the time, then the dealer is at the very least guilty of breaching the Sale Of Goods And Supply Of Services Act 1980 (in that the vehicle was both mis-represented and was ‘not of merchantable quality'). If he did know beforehand (and that can be very tricky to prove) then he’s guilty of fraud. I would go armed with legal backup and demand your money back, in full, and don’t leave the premises again until you’ve been refunded – either in cash or by bank transfer. Don’t accept a cheque and don’t accept any excuses. Just as a word to the wise, with any future purchases, always do a history and background check with a service such as Cartell.ie before you buy.
