Do private sellers have to give a warranty?

Is there a warranty obligation from the seller of a car to a buyer in a private sale?

Our answer:

Hi Robert,

No, a private seller is not required to offer you a warranty - essentially a private sale is always 'sold as seen.' Obviously, they have to fulfil their obligations under statutory consumer law - the car must be sold as described and be legally theirs to sell, but you'll only get a warranty (and not always then) if you buy from a professional dealer.
