
If vat has not been claimed on a commercial vehicle when bought when selling on does the private seller include vat in the price? Can the seller then give a vat invoice even if not vat registered?

No and no. First off, you need to be VAT-registered to either claim back VAT or pass it on, but VAT isn’t payable on used vehicles so if someone is trying this on to get you to pay more up front for a van, they’re telling you porkie-pies. VAT can only be claimed back against a new vehicle purchase, so it’s a non-runner on second hand stuff.
