Can I tax an SUV as a commercial?

I'm looking to buy a SUV and plan to tax it as a commercial vehicle (to avail of the €333 tax). I know some SUV are now classed as N1 vehicles, so they can have five seats and still be classed as a commercial. Am I right/wrong in saying that? Information seems to be scarce on this topic and most people seem confused as to the exact rules and regulations. I've also seen some unusual cars e.g. BMW X6, being classified as being commercial. Are there some weird cars jumping through loopholes in the car classification legal system?

It's down to the size of the boot and the payload capacity. Certainly there are many cars that you can tax as a commercial and keep five seats and glass windows (Jeep Grand Cherokee, Mitsubishi Pajero, Land Rover Discovery to name three), but there are apparently plans afoot in Government to tighten up the rules and reduce the number of cars that can be classified as commercial. 
 
Also, you have to make absolutely sure that your work justifies the use of a commercial vehicle or you could be stung for a €5,000 fine for improper road tax.
