Can I get my deposit back?
Hi, I left a deposit to buy a car by a simi dealer. deposit was given to check finance for approval. Finance was approved but Looking at the car leaflet we actually seen that the mileage that the dealer told us was in miles despite the fact the question was asked in Km. This is from 2014 and has 185.000Km. I'd ike to get the deposit back and rather look form way less Km especially considering the age of the car and the fact it has a towbar and only one owner ( meaning this was used ). Calling the seller, he said ' can't walk back' . I am inclined to think he's truing to force and secure the sale. Can you advise. Can I simply ask the deposit back? I din't sign a initial agreement but I din't actually sign the finance Authorisation. Thanks. Gio.

You’ll need to check the fine print of the finance agreement to see what the story is with returning any deposit, even if you didn’t sign it. The fact that you handed the money over, even without signing, implies that you agreed with the terms and conditions. That said, if you can definitely show that the car was advertised incorrectly, then you are entirely entitled to your money back, but I would have a chat with your solicitor before doing anything else.
