It is not technically illegal, but I'd be very wary of buying a car from anyone without an up-to-date NCT. 

I would point out that dealers regularly put cars up for sale before they put them through their NCTs, so it's worth checking with them that the car will have an NCT cert before it is sold - before you dismiss a car.
