1. General

These Terms & Conditions ("Terms") apply when you:

  • access or use www.carzone.ie (the "Website");
  • use our vehicle history and related services ("Car Check"); or
  • use our private seller portal and tools to create or manage advertisements ("Private Portal").

Carzone.ie ("Carzone", "we," "us," "our") is operated by Webzone Limited t/a Carzone, a subsidiary of Motion Group (part of Mediahuis Ireland).

The Website and related services are intended primarily for residents of Ireland. If you access the Website from outside Ireland, you do so at your own risk and are responsible for compliance with any laws applicable to you.

By using the Website or related services (including any SMS or email-based services we provide), you agree to be bound by these Terms as updated from time to time. If you do not agree, you must not use the Website or the related services.

We may amend these Terms at any time by posting an updated version on the Website. Where we make material changes, we will take reasonable steps to let you know (for example by a notice on the Website and/or by email, where appropriate). Your continued use of the Website or services after changes are posted means you accept the revised Terms.

These Terms apply in addition to any product-specific terms that apply to particular services (for example, dealer terms or specific online advertiser terms). If there is any conflict between these Terms and product-specific terms, the product-specific terms will apply for that particular service, to the extent of the conflict.

These Terms should be read together with our Privacy Policy and any other notices or policies we publish on the Website.

1.1 Definitions

In these Terms:

"we" / "us" / "our" – Carzone.ie and its group companies.

"you" / "your" – the customer or user who accesses the Website or related services, places or manages advertisements, submits a Car Check enquiry, or receives information from us.

"Website" – the Carzone.ie website and related online services that link to these Terms.

"Private Portal" – the portal through which a potential buyer or private seller can access their Carzone account and manage advertisements or saved content.

"Advertisement" / "Ad" – any listing or promotional material for vehicles, products or services published on the Website by or on behalf of a user (including private sellers and dealers).

"Car Check" – any car history, finance, write-off, mileage or related vehicle check service we provide via the Website, SMS or other channels.

"Enquiry" – a request for Car Check or related services submitted via the Website, by phone, SMS, or other approved channels.

"Carzone Content" – all Content and other reports, documents, designs, software, tools and materials supplied or made available by or on behalf of Carzone on or through the Website.

"Information" – information we supply in response to an Enquiry (for example, vehicle data from our electronic database).

"Contract" – the contract between you and us for the supply of Information and related services, subject to these Terms.

"User authentication" – the process we use to verify user identity for the Private Portal (currently via Amazon Cognito and/or social login).

"Email Comms" – email communications we send to you as a prospective buyer or private seller using a Carzone account.

"Content" – any text, data, images, photographs, graphics, video, audio, advertisements, vehicle descriptions, or other material on or through the Website.

"Materials" – the Carzone Content and any other reports, documents or materials supplied or made available to you on or through the Website.

1.2 Formation of Contract

Your use of the Website is governed by these Terms, our Privacy Policy and any other documents referred to in them. Each time you access or use the Website, you confirm that you accept and will comply with these Terms.

For Car Check and other paid digital services, a separate contract is created between you and us:

  • When you submit an Enquiry, you are offering to buy those services on these Terms and any product-specific terms presented to you at checkout.
  • A binding contract is formed only when we make the Information or service available to you (for example, when a Car Check report is generated and displayed, downloaded or emailed).

We may refuse to provide specific services where we reasonably believe you have breached these Terms.

1.3 Eligibility and Age Requirements

You must be legally capable of entering into binding contracts in order to:

  • create an account;
  • place Advertisements in your own name; or
  • buy paid services, including Car Check.

If you are under 18:

  • you may browse the Website for information with the knowledge and consent of a parent or legal guardian;
  • you must not create an account, place Advertisements in your own name, or enter into any contract for paid services; and
  • your parent or legal guardian is responsible for supervising your use of the Website and ensuring that you comply with these Terms.

We may refuse, restrict or terminate access where we reasonably believe these eligibility requirements are not met.

If you act as a consumer (that is, for purposes mainly outside your trade, business or profession), you may have additional rights under Irish and EU consumer law. Nothing in these Terms is intended to exclude or limit any rights you have which cannot lawfully be excluded or limited.

2. Website Conditions of Use

Each time you access the Website, you are deemed to have read, understood and accepted these Terms.

If you have any questions about these Terms, please contact us using the details in Section 23.

2.1 Status as an Online Platform

Carzone operates an online platform and "information society service" under applicable EU and Irish law. Where we host or store information provided by third parties (for example, Advertisements, vehicle descriptions and other user-generated content), we act as an intermediary and are not under a general obligation to:

  • monitor such information; or
  • actively seek facts or circumstances indicating unlawful activity.

This does not affect:

  • any checks or reviews we may choose to perform; or
  • any legal obligations we may have to comply with court orders or lawful requests from public authorities.

2.2 Relationship Between Buyers, Sellers and Carzone

The Website and Private Portal facilitate contact between buyers and sellers of vehicles and related products and services. Unless we expressly agree otherwise in writing, Carzone:

  • is not a party to any contract for the sale or purchase of a vehicle or other goods or services advertised on the Website;
  • does not own or physically hold vehicles advertised on the Website; and
  • does not act as agent, broker or guarantor for any buyer or seller.

Any contract for sale or purchase is made directly between the relevant buyer and seller, on terms they agree between them and not on or via the Website. You are solely responsible for:

  • verifying the identity and legitimacy of other users;
  • checking vehicle ownership, condition, mileage, history and any finance, write-off or category status; and
  • complying with all applicable legal and regulatory requirements (for example, consumer law, tax, insurance and vehicle registration).

You remain responsible for carrying out your own checks and inspections, as further explained in Sections 5 and 7.

2.3 Acceptable Use and Prohibited Activities

You agree to use the Website, Private Portal and related services only for lawful purposes and in line with these Terms and any policies we publish.

You must not, for example:

Unlawful or harmful content

  • use the Website for any unlawful purpose or in breach of any applicable law, regulation or code of practice;
  • upload or transmit any material that is defamatory, abusive, harassing, obscene, discriminatory, hateful, invasive of privacy or otherwise objectionable.

Infringement of rights and misrepresentation

  • upload or use Content that infringes any person's intellectual property, privacy or other rights;
  • misrepresent your identity or your affiliation with any person or entity, or falsely present yourself as a private seller when acting in the course of business (or vice versa).

Misleading or abusive Advertising

  • place Advertisements that are false, misleading, deceptive or incomplete, including misleading pricing or inaccurate descriptions of vehicle condition, mileage or history;
  • use excessive, irrelevant or misleading keywords or brand names to manipulate search results;
  • advertise goods or services prohibited by law or by any policies or guidelines we publish.

Spam and unauthorised communications

  • send unsolicited bulk messages (spam) to other users;
  • harvest or collect email addresses or other contact details to send unsolicited communications.

Technical misuse and security

  • attempt to gain unauthorised access to any part of the Website, Private Portal, our systems or other users' accounts;
  • test, scan, probe or circumvent any security or authentication measures;
  • use any robot, spider, scraper or automated tool to access the Website without our prior written permission (except where such use is permitted by law and cannot be restricted by contract);
  • introduce viruses, malicious code or other harmful material; or
  • interfere with or disrupt the operation of the Website or our infrastructure, or use the Website in a way that could damage, disable, overburden or impair our systems or the experience of other users.

Other restrictions

You must not:

  • copy or store Content other than for your own personal use as allowed by these Terms or applicable law;
  • use the Website for advertising, marketing, campaigning or public-relations activities except where this is expressly allowed in our product-specific terms;
  • impersonate any person or entity; or
  • upload or make available any material you do not have a right to share.

We may remove, edit or restrict access to any Advertisement or Content, or suspend or terminate any account, where we reasonably believe these provisions have been breached or we are required to act by law or a competent authority (see also Section 17).

3. Private Portal

3.1 Overview

The Private Portal allows private sellers to log in and create, view, and manage their own Advertisements. Access to the Private Portal is via desktop or compatible mobile web.

3.2 User Authentication and Security

To protect your account, we may require you to complete user authentication, which may include email registration and activation and/or social login through supported providers.

You are responsible for keeping your login credentials secure and for all activity on your account. If you believe your account has been compromised, you should contact us promptly using the details on the Website.

3.3 Prospective Buyers and Saved Content

If you use features such as "save" or "favourite" on Advertisements:

  • Your selections will be added to your saved ads list in your current browser only.
  • You can manage this list by directly engaging with the Saved Ads option on the nav (top of the site on desktop) or this option in the side menu on mobile.

4. Advertisements (Private Sellers)

4.1 Ad Creation and Duration

When creating an Advertisement as a private seller, you will be presented with available plans and any applicable fees.

Unless we tell you otherwise during the creation process:

  • online Advertisements will normally remain live for up to 12 months or until you mark the vehicle as sold or remove the Ad, whichever happens first;
  • after 12 months, we may contact you to confirm if you still wish to advertise the vehicle. If you confirm that you do, we may renew your Ad for a further period, which may be free of charge or subject to fees, as indicated at that time.

We may remove or suspend Advertisements that appear inactive or not maintained for extended periods in order to keep listings current. Where removal is due only to inactivity, no refund or credit will normally be due.

4.2 Removal of Ads and Refunds

We may remove, suspend or unpublish an Advertisement where, for example:

  • you have breached these Terms or any applicable policy;
  • the Advertisement or its content is illegal, misleading or infringes third-party rights;
  • we are required to do so to comply with legal or regulatory requirements or a request from a competent authority; or
  • it is necessary to protect the Website, our systems or other users.

Where we remove or suspend an Advertisement for reasons above, fees already paid will normally not be refundable. Any replacement advertising credit will be at our reasonable discretion and subject to applicable consumer rights (see Section 10).

4.3 Discount Codes and Promotions

From time to time, we may offer discount codes or promotions for certain services. Each offer will set out applicable terms, such as:

  • validity period;
  • eligible products;
  • any minimum spend or other conditions.

To use a discount code, you must enter it in the designated field during checkout before you complete payment. If you do not apply the code at that stage, we cannot retrospectively apply the discount to that order.

5. Car Check and Information Services

Car Check Information is compiled from multiple third-party data sources. We do not guarantee that it is complete, accurate or up to date, and it may not include all information about a vehicle's history. You must not rely on a Car Check as the sole basis for deciding whether to buy or sell a vehicle; you remain responsible for carrying out appropriate inspections and checks.

5.1 Definitions

For Car Check and related information services:

  • "Car Check" is any car history, finance, write-off, mileage, or related vehicle check we provide.
  • "Enquiry" is a request you submit for such services.
  • "Information" is the data we provide back to you in response to an Enquiry.

5.2 Formation of Contract for Car Check

When you submit an Enquiry, you are offering to enter into a contract with us for the supply of Car Check services under these Terms and any product-specific terms shown at the point of purchase.

A contract is formed only when we provide the Information to you (for example, when we display, download or send the Car Check report). We may decline an Enquiry or refuse to enter into a contract for any reason, acting reasonably.

You must:

  • provide accurate and complete details when making an Enquiry; and
  • contact us if the Information appears to contain obvious errors.

5.3 Use of the Information

Information supplied in response to an Enquiry is for your personal use (or your internal business use, where you are a business user). You must not sell, license or disclose the Information to third parties, except that you may:

  • provide a complete and unaltered copy to a potential buyer or seller of the relevant vehicle, free of charge, in the context of negotiating its sale or purchase.

You must not alter the Information or present it in a misleading or incomplete way.

6. Vehicle Eligibility – Category A/B Write-Offs

We may use data from insurers and other third-party providers to identify vehicles recorded as Category A or Category B write-offs ("Category A/B Vehicles").

Where a vehicle is recorded as a Category A/B Vehicle, we may at any time:

  • refuse to publish an Advertisement for that vehicle;
  • suspend, unpublish or remove an existing Advertisement for that vehicle; and
  • block re-publication of that vehicle on the Website or on any dealer or white-label sites we operate or host.

If data for a vehicle is incomplete or delayed, we may allow an Advertisement to go live. If we later receive information that it is a Category A/B Vehicle, we may then suspend, unpublish or remove the Advertisement.

If you believe a vehicle has been wrongly identified as a Category A/B Vehicle, you may contact our customer support team with supporting evidence. If we are satisfied that the vehicle is not a Category A/B Vehicle, we may lift restrictions and may, at our discretion, reinstate the Advertisement and/or issue replacement advertising credit.

You acknowledge that we rely in good faith on third-party information and, provided we act reasonably and in good faith, we will not be liable for losses arising from our decision to refuse, suspend, unpublish, remove or block an Advertisement for a vehicle we reasonably believe to be a Category A/B Vehicle.

7. Information for Buyers – Vehicle History and Write-Offs

We use reasonable efforts, including checks against data from insurers and other providers, to reduce the risk of Category A/B Vehicles being advertised on Carzone.ie or white-label sites we operate or host, and we do not knowingly permit such Ads.

However, we cannot guarantee that:

  • all information provided by sellers or third-party providers is accurate, complete or up to date; or
  • every Category A/B Vehicle will be identified before an Advertisement goes live (for example, where registration details are missing, data is delayed or third-party systems contain errors).

You accept that:

  • Advertisements and vehicle descriptions are provided by sellers and/or third parties and are not independently verified by us; and
  • you remain responsible for carrying out your own checks and inspections (including independent history, finance and write-off checks) before buying a vehicle.

If we become aware that an advertised vehicle is recorded as a Category A/B Vehicle, we will act in line with our policy, which may include removing the Advertisement.

8. User Content and Intellectual Property Rights

8.1 Carzone Content

We and our licensors own all rights for the Website and the Carzone Content, including copyright, database rights, trademarks and other intellectual property rights.

You may:

  • view and use Carzone Content for your own personal reference while using the Website;
  • print a single copy or download reasonable extracts for that purpose.

You must not:

  • modify paper or digital copies you have printed or downloaded;
  • use images, graphics or other elements separately from accompanying text;
  • use any Carzone Content for commercial purposes without our prior written permission, unless allowed by applicable law.

Our status (and that of our partners, advertisers and identified third parties) as authors or rights-holders in Carzone Content must always be acknowledged.

Nothing on the Website grants you any licence or right to use any logo, trade mark or other intellectual property without the prior written consent of the relevant owner.

8.2 User Content Licence and Moral Rights

By posting, uploading or submitting Content (including images, descriptions and other materials) to the Website or Private Portal, you:

  • grant Carzone, its group companies and service providers a non-exclusive, worldwide, royalty-free, fully paid-up, transferable and sublicensable licence to use, host, store, reproduce, modify (for technical and formatting reasons), adapt, publish, translate, distribute, display and otherwise make available such Content in connection with:
    • operating and improving the Website, Private Portal and related services (including displaying and syndicating Advertisements); and
    • promoting the Website, Private Portal and related services.
  • confirm that you have the necessary rights and permissions to grant this licence and that your Content does not break any laws or infringe any third-party rights.

This licence continues for as long as your Content is held on our systems and for a reasonable period afterwards to allow us to:

  • remove copies from backups, caches and technical systems; and
  • honour any existing uses already made in reliance on this licence (for example, marketing materials or syndication already in circulation).

If you delete Content or your account is closed, we will stop using that Content for new purposes within a reasonable period. This will not affect uses already made that cannot reasonably be undone.

Moral rights (where applicable): To the extent permitted by law, you consent to us using, adapting, editing, publishing or removing the Content (including creating derivative works) and you agree not to assert any moral rights you may have in the Content against us or our related parties.

9. Linked Sites

The Website may include links to third-party websites. We do not control and are not responsible for the content, availability or practices of those websites, nor do we endorse any material on them.

You must not create a link to the Website from another site without our prior written consent. If we grant permission, we may set conditions (for example, that you link only to the homepage and only from sites you own and operate). We may withdraw linking permission at any time.

10. Charges and Right of Withdrawal for Consumers

10.1 Charges

You agree to pay our charges for Information, advertising and other services at the rates in force at the time of your order, using a payment method we accept. All applicable fees and taxes will be shown during the order process.

10.2 Right of Withdrawal for Consumers

If you are a consumer and you buy a service online, you may have a legal right to withdraw from the contract within 14 days without giving any reason.

However, this right may be affected where:

  • the service is fully performed within the withdrawal period at your express request (for example, a Car Check report generated and delivered soon after purchase); or
  • the service is partially performed during the withdrawal period at your request (for example, an Advertisement that has already been published).

We will explain at checkout when:

  • you are asked to request immediate performance; and
  • you acknowledge that you may lose your right of withdrawal once the service has been fully performed.

For Car Check and similar one-off digital services, once we have fully delivered the Information you requested in the way agreed, you may lose your right of withdrawal.

For time-based advertising services (for example, an online Ad that runs for a period), if you request that we begin providing the service during the withdrawal period:

  • you may still cancel within 14 days; however, we may be entitled to a proportionate amount of the price for services already provided up to the time you inform us of your wish to withdraw;
  • where the service has been fully performed at your request within the withdrawal period, you may lose your right of withdrawal.

Any additional refund or credit policies applying to particular products or plans will be explained during the order process and will form part of the contract.

Nothing in this section affects your mandatory rights under Irish and EU consumer law.

11. Disclaimer

The Website, Carzone Content and related services are provided "as is" and "as available". We do not promise that the Website will always be uninterrupted, error-free, secure or free from viruses or other harmful components.

You should not rely on any Content as the sole basis for making decisions. Your use of the Website and services is at your own risk, subject to your statutory rights.

Nothing in these Terms excludes or limits any rights you may have under Irish or EU consumer law that cannot be excluded or limited by contract.

12. Limitation of Liability

12.1 Hosting of Third-Party Content

The Website contains information provided by third parties (including advertisers, sellers, data providers and other users). Where such information is stored or hosted at their request, our responsibility is limited in accordance with EU and Irish law, including the Digital Services Act.

We are not liable for information stored at the request of a third party where:

  • we have no actual knowledge of illegal activity or information and are not aware of facts or circumstances from which the illegality is apparent; or
  • upon gaining such knowledge or awareness, we act promptly to remove or disable access to the information.

12.2 General Limitation and Force Majeure

To the fullest extent permitted by law:

  • all warranties, conditions and other terms implied by law are excluded, except where they cannot lawfully be excluded; and
  • we will not be liable for any indirect, special, consequential or incidental loss or damage, or for any loss of profit, revenue, business, data, goodwill or anticipated savings, arising out of or in connection with the Website, Carzone Content, Information or these Terms, whether in contract, tort (including negligence) or otherwise, even if foreseeable.

We are not responsible for any loss or inconvenience caused by events beyond our reasonable control ("force majeure"), including but not limited to government action, war, civil strife, industrial dispute, terrorist activity, natural disaster, fire, flood, severe weather or the threat of any of these.

We will not be liable for loss or damage caused by viruses, malicious code, denial-of-service attacks or other harmful material that may affect your equipment, software, data or other property due to your use of the Website or your downloading of any content from the Website or linked sites.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish or EU law.

12.3 Consumer Rights

If you are a consumer, nothing in these Terms is intended to exclude or limit any statutory rights you may have under Irish or EU consumer law that cannot be excluded or limited by contract, including any rights to remedies where we fail to provide digital content or services in conformity with the contract.

13. Indemnification

You agree to indemnify and keep Carzone, its parent, subsidiaries, affiliates and their officers, directors and employees harmless from any claims, losses, damages, costs and expenses (including reasonable legal fees) arising out of:

  • your unlawful use of the Website, Carzone Content, Information or Materials;
  • your intentional or negligent breach of these Terms; or
  • your actual or alleged infringement of any third-party intellectual property or other rights.

If you are a consumer, this indemnity applies only to the extent permitted under applicable consumer law.

14. Use of Your Personal Data – Car Check

We obtain and hold vehicle and related data from multiple sources (including finance companies, insurers and other organisations). This data helps protect users who make searches and vehicle owners whose details appear in data sources we rely on.

You agree that, where allowed by data protection law and where necessary and proportionate, we may disclose relevant information about you (such as your name, address and details of your use of our services) for purposes including:

  • preventing, detecting or investigating crime;
  • protecting the rights or property of others; or
  • assisting in the recovery of stolen vehicles,

for example to:

  • a verified owner of a vehicle about which you have made an Enquiry (once we have taken reasonable steps to verify their identity and ownership); or
  • law enforcement or other competent authorities.

Further information about how we process personal data is set out in our Privacy Policy. Any such disclosures will be made in accordance with applicable data protection law.

15. Use of Your Personal Data – Website and Private Portal

We will use your personal data in accordance with our Privacy Policy and any product-specific privacy notices we provide.

In particular, we may use your data to:

  • enhance your search experience as a prospective buyer; and
  • support your sales journey as a private seller, including managing your account, Advertisements and related communications.

Some communications (for example, about your account, Advertisements, security or legal updates) are necessary for the operation of the Website and cannot be turned off while you use the relevant service. Marketing communications will only be sent where permitted by law, and you can withdraw your consent or object as described in our Privacy Policy.

You may request deletion of your data by contacting us as set out in the Privacy Policy, subject to our need to retain certain data for legal or regulatory reasons.

16. Digital Services Act (DSA) Information and Notice & Action Mechanism

Carzone confirms that, for the purposes of Article 24(2) of the Digital Services Act, it has an average of fewer than 45 million monthly active recipients in the EU, calculated over the previous six-month period.

If you believe Content on the Website is illegal or infringes your rights, you may notify us by:

  • using any "report" or complaint tools available on the Website; and/or
  • using any dedicated DSA contact information or systems we make available.

To help us assess your notice, please provide:

  • a clear description of the Content and where it appears on the Website (for example, URL or Advertisement ID);
  • the reasons you consider the Content illegal or infringing, including any legal references where possible; and
  • your name and contact details.

If your notice is incomplete, we may ask for more details. When we obtain actual knowledge or awareness of illegal content, we will act promptly to remove or disable access to it in line with our legal obligations. Where required by law, we will inform you of our decision and provide information on available complaint or redress mechanisms, including any out-of-court dispute settlement options.

We may take appropriate action, including restricting or suspending access to the Website, where a user repeatedly submits manifestly unfounded or abusive notices.

Our most recent DSA transparency information will be available on the Website.

17. Account Suspension, Termination and Content Moderation

We may, at any time and without liability, take one or more of the following actions, acting reasonably and in accordance with applicable law (including the Digital Services Act):

  • suspend, restrict or terminate your access to the Website, Private Portal or your account;
  • remove, suspend, unpublish or restrict access to any Advertisement or other Content you have submitted;
  • apply technical or other measures to prevent or restrict access to the Website or specific features or Content.

We may do so where, for example:

  • we reasonably believe you have breached these Terms, other applicable policies or any law;
  • we receive a notice or complaint indicating that Content is illegal or infringes third-party rights;
