Carzone.ie ("Carzone", "we," "us," "our") is operated by Webzone Limited t/a Carzone, a subsidiary of Motion Group (part of Mediahuis Ireland).
The Website and related services are intended primarily for residents of Ireland. If you access the Website from outside Ireland, you do so at your own risk and are responsible for compliance with any laws applicable to you.
By using the Website or related services (including any SMS or email-based services we provide), you agree to be bound by these Terms as updated from time to time. If you do not agree, you must not use the Website or the related services.
We may amend these Terms at any time by posting an updated version on the Website. Where we make material changes, we will take reasonable steps to let you know (for example by a notice on the Website and/or by email, where appropriate). Your continued use of the Website or services after changes are posted means you accept the revised Terms.
These Terms apply in addition to any product-specific terms that apply to particular services (for example, dealer terms or specific online advertiser terms). If there is any conflict between these Terms and product-specific terms, the product-specific terms will apply for that particular service, to the extent of the conflict.
These Terms should be read together with our Privacy Policy and any other notices or policies we publish on the Website.
In these Terms:
"we" / "us" / "our" – Carzone.ie and its group companies.
"you" / "your" – the customer or user who accesses the Website or related services, places or manages advertisements, submits a Car Check enquiry, or receives information from us.
"Website" – the Carzone.ie website and related online services that link to these Terms.
"Private Portal" – the portal through which a potential buyer or private seller can access their Carzone account and manage advertisements or saved content.
"Advertisement" / "Ad" – any listing or promotional material for vehicles, products or services published on the Website by or on behalf of a user (including private sellers and dealers).
"Car Check" – any car history, finance, write-off, mileage or related vehicle check service we provide via the Website, SMS or other channels.
"Enquiry" – a request for Car Check or related services submitted via the Website, by phone, SMS, or other approved channels.
"Carzone Content" – all Content and other reports, documents, designs, software, tools and materials supplied or made available by or on behalf of Carzone on or through the Website.
"Information" – information we supply in response to an Enquiry (for example, vehicle data from our electronic database).
"Contract" – the contract between you and us for the supply of Information and related services, subject to these Terms.
"User authentication" – the process we use to verify user identity for the Private Portal (currently via Amazon Cognito and/or social login).
"Email Comms" – email communications we send to you as a prospective buyer or private seller using a Carzone account.
"Content" – any text, data, images, photographs, graphics, video, audio, advertisements, vehicle descriptions, or other material on or through the Website.
"Materials" – the Carzone Content and any other reports, documents or materials supplied or made available to you on or through the Website.
Your use of the Website is governed by these Terms, our Privacy Policy and any other documents referred to in them. Each time you access or use the Website, you confirm that you accept and will comply with these Terms.
For Car Check and other paid digital services, a separate contract is created between you and us:

Carzone operates an online platform and "information society service" under applicable EU and Irish law. Where we host or store information provided by third parties (for example, Advertisements, vehicle descriptions and other user-generated content), we act as an intermediary and are not under a general obligation to:

Any contract for sale or purchase is made directly between the relevant buyer and seller, on terms they agree between them and not on or via the Website. You are solely responsible for:
You remain responsible for carrying out your own checks and inspections, as further explained in Sections 5 and 7.
You agree to use the Website, Private Portal and related services only for lawful purposes and in line with these Terms and any policies we publish.

We may remove, edit or restrict access to any Advertisement or Content, or suspend or terminate any account, where we reasonably believe these provisions have been breached or we are required to act by law or a competent authority (see also Section 17).
The Private Portal allows private sellers to log in and create, view, and manage their own Advertisements. Access to the Private Portal is via desktop or compatible mobile web.
To protect your account, we may require you to complete user authentication, which may include email registration and activation and/or social login through supported providers.
You are responsible for keeping your login credentials secure and for all activity on your account. If you believe your account has been compromised, you should contact us promptly using the details on the Website.
If you use features such as "save" or "favourite" on Advertisements:
When creating an Advertisement as a private seller, you will be presented with available plans and any applicable fees.
Unless we tell you otherwise during the creation process:
We may remove or suspend Advertisements that appear inactive or not maintained for extended periods in order to keep listings current. Where removal is due only to inactivity, no refund or credit will normally be due.
We may remove, suspend or unpublish an Advertisement where, for example:
Where we remove or suspend an Advertisement for reasons above, fees already paid will normally not be refundable. Any replacement advertising credit will be at our reasonable discretion and subject to applicable consumer rights (see Section 10).
From time to time, we may offer discount codes or promotions for certain services. Each offer will set out applicable terms, such as:
To use a discount code, you must enter it in the designated field during checkout before you complete payment. If you do not apply the code at that stage, we cannot retrospectively apply the discount to that order.
Car Check Information is compiled from multiple third-party data sources. We do not guarantee that it is complete, accurate or up to date, and it may not include all information about a vehicle's history. You must not rely on a Car Check as the sole basis for deciding whether to buy or sell a vehicle; you remain responsible for carrying out appropriate inspections and checks.
For Car Check and related information services:
When you submit an Enquiry, you are offering to enter into a contract with us for the supply of Car Check services under these Terms and any product-specific terms shown at the point of purchase.
A contract is formed only when we provide the Information to you (for example, when we display, download or send the Car Check report). We may decline an Enquiry or refuse to enter into a contract for any reason, acting reasonably.

Information supplied in response to an Enquiry is for your personal use (or your internal business use, where you are a business user). You must not sell, license or disclose the Information to third parties, except that you may:
You must not alter the Information or present it in a misleading or incomplete way.
We may use data from insurers and other third-party providers to identify vehicles recorded as Category A or Category B write-offs ("Category A/B Vehicles").
Where a vehicle is recorded as a Category A/B Vehicle, we may at any time:
If data for a vehicle is incomplete or delayed, we may allow an Advertisement to go live. If we later receive information that it is a Category A/B Vehicle, we may then suspend, unpublish or remove the Advertisement.
If you believe a vehicle has been wrongly identified as a Category A/B Vehicle, you may contact our customer support team with supporting evidence. If we are satisfied that the vehicle is not a Category A/B Vehicle, we may lift restrictions and may, at our discretion, reinstate the Advertisement and/or issue replacement advertising credit.
You acknowledge that we rely in good faith on third-party information and, provided we act reasonably and in good faith, we will not be liable for losses arising from our decision to refuse, suspend, unpublish, remove or block an Advertisement for a vehicle we reasonably believe to be a Category A/B Vehicle.
We use reasonable efforts, including checks against data from insurers and other providers, to reduce the risk of Category A/B Vehicles being advertised on Carzone.ie or white-label sites we operate or host, and we do not knowingly permit such Ads.
However, we cannot guarantee that:

If we become aware that an advertised vehicle is recorded as a Category A/B Vehicle, we will act in line with our policy, which may include removing the Advertisement.
We and our licensors own all rights for the Website and the Carzone Content, including copyright, database rights, trademarks and other intellectual property rights.

Our status (and that of our partners, advertisers and identified third parties) as authors or rights-holders in Carzone Content must always be acknowledged.
Nothing on the Website grants you any licence or right to use any logo, trade mark or other intellectual property without the prior written consent of the relevant owner.
By posting, uploading or submitting Content (including images, descriptions and other materials) to the Website or Private Portal, you:
This licence continues for as long as your Content is held on our systems and for a reasonable period afterwards to allow us to:
If you delete Content or your account is closed, we will stop using that Content for new purposes within a reasonable period. This will not affect uses already made that cannot reasonably be undone.

The Website may include links to third-party websites. We do not control and are not responsible for the content, availability or practices of those websites, nor do we endorse any material on them.
You must not create a link to the Website from another site without our prior written consent. If we grant permission, we may set conditions (for example, that you link only to the homepage and only from sites you own and operate). We may withdraw linking permission at any time.
You agree to pay our charges for Information, advertising and other services at the rates in force at the time of your order, using a payment method we accept. All applicable fees and taxes will be shown during the order process.
If you are a consumer and you buy a service online, you may have a legal right to withdraw from the contract within 14 days without giving any reason.

For Car Check and similar one-off digital services, once we have fully delivered the Information you requested in the way agreed, you may lose your right of withdrawal.

Nothing in this section affects your mandatory rights under Irish and EU consumer law.
The Website, Carzone Content and related services are provided "as is" and "as available". We do not promise that the Website will always be uninterrupted, error-free, secure or free from viruses or other harmful components.
You should not rely on any Content as the sole basis for making decisions. Your use of the Website and services is at your own risk, subject to your statutory rights.
Nothing in these Terms excludes or limits any rights you may have under Irish or EU consumer law that cannot be excluded or limited by contract.
The Website contains information provided by third parties (including advertisers, sellers, data providers and other users). Where such information is stored or hosted at their request, our responsibility is limited in accordance with EU and Irish law, including the Digital Services Act.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish or EU law.
If you are a consumer, nothing in these Terms is intended to exclude or limit any statutory rights you may have under Irish or EU consumer law that cannot be excluded or limited by contract, including any rights to remedies where we fail to provide digital content or services in conformity with the contract.
You agree to indemnify and keep Carzone, its parent, subsidiaries, affiliates and their officers, directors and employees harmless from any claims, losses, damages, costs and expenses (including reasonable legal fees) arising out of:

We obtain and hold vehicle and related data from multiple sources (including finance companies, insurers and other organisations). This data helps protect users who make searches and vehicle owners whose details appear in data sources we rely on.
You agree that, where allowed by data protection law and where necessary and proportionate, we may disclose relevant information about you (such as your name, address and details of your use of our services) for purposes including:

These Terms, the Website and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Ireland.

We may assign, transfer or subcontract any of our rights and obligations under these Terms to another entity at any time. We will let you know if this happens where required by law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
These Terms, together with our Privacy Policy, product-specific terms and any other documents referred to in them, constitute the entire agreement between you and us in relation to the Website and our relevant services, and replace any previous understandings or agreements relating to the same subject matter (except in the case of fraud or fraudulent misrepresentation).
